Musk's Terafab chip venture faces trademark challenge from decade-old lithography firm
Elon Musk's semiconductor startup Terafab has encountered a legal obstacle before production begins: a small U.S. company called Tera-print, which has marketed Tera-Fab-branded lithography tools for roughly ten years, sent a cease-and-desist letter demanding the name be abandoned.

Terafab, the chip manufacturing initiative backed by Musk's companies, collided with an unexpected legal hurdle when Tera-print, a compact U.S. firm, dispatched a cease-and-desist notice to SpaceX and Tesla in May. The dispute centers on trademark rights to a name that Tera-print has applied to its products since roughly a decade ago, according to reporting from PCMag.
Tera-print manufactures and sells equipment branded as Tera-Fab, specifically beam pen lithography (BPL) systems designed for bioengineering applications and the prototyping of microfluidic devices. The company counts the U.S. Department of Defense among its clientele for these Tera-Fab tools.
The disagreement hinges on whether the two ventures operate in sufficiently distinct domains to avoid consumer confusion. Tera-print contends that the Terafab designation creates trademark overlap with its established Tera-Fab brand. By contrast, Tesla, SpaceX, and SpaceXAI argue that their operations differ fundamentally from Tera-print's business. Terafab intends to manufacture semiconductor chips at massive scale for applications spanning artificial intelligence, automotive systems, robotics, and space technology, whereas Tera-print's Tera-Fab represents a benchtop instrument for specialized prototyping and bioengineering work.
From a trademark registration standpoint, both entities claim rights within the semiconductor technology classification, though with distinct product descriptions:
- Tesla's Terafab trademark encompasses 'custom manufacture of semiconductor chips, memory chips, integrated circuits, and wafers' (IC 040) along with 'distribution services, namely, delivery of semiconductor chips, chip carriers, namely, semiconductor chip housings, memory chips, integrated circuits, semiconductors, and microchips' (IC 039).
- Tera-print's Tera-Fab trademark covers 'Polymer pen and beam pen lithography instruments in the nature of 3D micro-printers and 3D nano-scale printers' (IC 007); 'Polymer pen and beam pen lithography instruments in the nature of 2D micro-scale molecular and material printers and 2D nano-scale molecular and material printers' (IC 009); 'Light-directed photochemical synthesis tools; Industrial advanced materials synthesis tools; Advanced light projection systems; High precision force-feedback sample alignment modules; Environmental control sample chambers' (IC 009); and 'training services in the field of AI design and development, electronics, computer science, biology, and material science' (IC 042).
Settlement discussions took place between the two parties, and Tesla reportedly made an offer during negotiations. However, Tera-print states that Tesla indicated a preference for continuing talks rather than pursuing court resolution. Tera-print has signaled its intention to defend its registered trademark, maintaining that the companies operate within related fields that could generate consumer confusion.
